1.1
The scope outlined in these terms and conditions includes training programmes provided by the University Sports Department at Ruhr-Universität Bochum, Universitätsstraße 150, 44780 Bochum.
1.2
By booking a training programme or participating in a training programme, the participant recognises these terms and conditions: they are therefore part of the contract between the participant and Ruhr-Universität Bochum.
2.1
The following are principally entitled to participate:
2.2
In order to participate in the course programme or training programme under clauses 2.2.1 to 2.2.6, the selected course or training must be booked.
2.2.1
Course programme refers to all courses that take place at regular intervals within a defined period and under supervision by an instructor.
2.2.2
Special events are all university sports events (except sports excursions) that do not recur within a defined period. These include, for example, workshops or tournaments / leagues organised by University Sports.
2.2.3
Subscriptions are all recurring uses of sports facilities without supervision by an instructor for a defined period of time.
2.2.4
One-off bookings refer to one-time uses of sports facilities without supervision by an instructor.
2.2.5
Sports excursions are all university sports events that do not recur within a defined period of time (one-off events) and are additionally labelled as excursions in University Sports media.
2.2.6
Unifit training is any training that takes place in the Unifit gym facilities. For unsupervised training in the gym facilities, the booking of a Unifit card is required.
2.2.6.1
Unifit card:
Unifit cards are all bookings with dynamic and therefore semester-independent running times that entitle the holder to unsupervised training in the gym facilities.
In order to book a Unifit card, booking of and participation in a starter course is required.
2.2.6.2
Unifit Starter courses:
A starter courses includes one or several connected training units.
In order to subsequently obtain the booking permission of a Unifit card, all starter course units must be attended. If the starter course is not attended in full, permission to book the Unifit card will not be granted.
2.2.6.3
Other supervised training formats:
Supervised training formats are all offers that include supervision of a training unit.
2.3
Participants must prove their eligibility to participate and their status during checks conducted by the Ruhr-Universität’s University Sports staff and other persons who have the right to ban individuals from the premises. The following proof must be presented at an inspection:
Participants are obliged to inform University Sports immediately of any change of status within the period of the booked programme. University Sports reserves the right to compensate for any differences in fees resulting from the change of status.
3.1
Registration for university sports can be completed online via the University Sports Bochum website or in person at the University Sports service points.
3.2
The fee for all training programmes listed on the homepage can be paid either by direct debit or in cash at the University Sports office. By providing their account details during booking, the participant agrees to direct debiting and authorises Universitätskasse Bochum to collect the fee for the booked training programme; this authorisation may be cancelled at any time.
3.3
If the account details given during online booking are incorrect or if the account does not have the required funds, the respective bank is not obliged to honour the payment. Any return debit charges incurred by the bank, if they were caused by the debtor, shall be borne by the debtor.
3.4
In the event that direct debiting fails due to insufficient funds in the account or incorrect account details, the participant shall be blocked from further registrations until the fee and the return debit fee have been paid. In the event of a repeated failure of direct debiting, or if the participant fails to pay the fee and the return debit fee within the stipulated deadline after being requested to do so by University Sports, Ruhr-Universität reserves the right to temporarily or permanently exclude the participant from the sports programmes offered by University Sports. The same applies if a participant incorrectly states their status when registering.
Participation tickets of booked training programmes are generally not transferable. Ruhr-Universität reserves the right to make exceptions in justified cases.
5.1
The booked training programme can be cancelled until three working days before the first training date listed online.
5.2
After that date, the booked training programme generally cannot be cancelled.
5.3
The only regular exception to the regulations described under 5.1 and 5.2 is a medical certificate confirming an inability to participate in sport activities under the following conditions:
The inability to participate in sport activities must last for at least half of the remaining duration of the course.
The medical certificate must be presented to University Sports no later than 14 days after the start of the illness. Otherwise the right to refund expires.
Decisive for the refundable portion is the start of the illness. If at that point
5.4
In other justified cases, Ruhr-Universität reserves the right to make exceptions to the regulations outlined in 5.2.
5.5
If the amount per refund as per clause 5.3 is equal to or less than 5 €, University Sports is not obliged to refund.
5.6
For all cross-course and/or cross-offer card models (Fitness Card, Fitness Card Plus, Playgroup Card, Online-Card) regulations under 5.1, 5.2, 5.3, 5.4 and 5.5 shall apply.
6.1
For special events, regulations under 5.1, 5.2 and 5.4 shall apply. Tournaments organised by University Sports are an exception: in these cases, participants must cancel by the entry deadline stated in the respective tournament notice.
6.2
Regulations 5.3 and 5.5 do likewise apply; however, the medical certificate must be presented to University Sports before the respective special event takes place. If the medical certificate is presented to University Sports after the event, the participant is generally not entitled to a refund.
7.1
For subscriptions, regulations 5.1, 5.2 and 5.4 shall apply.
7.2
Regulations 5.3 and 5.5 do likewise apply, but the refundable portion is calculated as a percentage of the remaining term of the subscription.
8.1
The booking is binding. After the booking, the participant is generally not entitled to a refund

If the medical certificate is presented to University Sports after the one-off booking, the participant is generally not entitled to a refund.
9.1
For sport excursions, cancellation is possible up to six weeks before the first day of the excursion as stated online. If the participant wishes to cancel
These regulations also apply if a medical certificate confirming the inability to participate in sport activities is provided. (Therefore, all participants are advised to purchase a private travel cancellation insurance.)
9.2
In the case of sports excursions where equipment that is not included in the fee for the excursion was additionally booked via University Sports, it is possible to cancel the booking up to three working days before the start of the excursion. Whether or not equipment is included in the excursion fee can be found on the website under “Leistungen” (“services”).
10.1
Unifit card:
Unifit cards are all bookings with dynamic and therefore semester-independent running times that entitle the holder to unsupervised training in the gym facilities.
In order to book a Unifit card, booking of and participation in a starter course is required.
10.1.2
The booking of a Unifit card is binding. After the booking, the participant is generally not entitled to a refund.
10.1.3
Cancelling a booked Unifit card is only possible due to a permanent inability to participate in sport activities, as confirmed by a medical certificate or if the participant cannot be reasonably expected to execute their usage rights for a period of at least 30 continuous days due to due to absence from the place of study or the place of work (as proven by e.g. certificate from the examination office, internship contract or similar or, in case of absence from the place of work, by a certificate from a superior or similar).
Decisive for the refundable portion is the date by which the certificate was presented. The payments still outstanding at that time are cancelled with immediate effect.
If the refundable amount is equal to or less than 5€, university sports is exempt from the refund obligation.
10.1.4
It is generally not possible to suspend active Unifit cards.
10.1.5
In justified cases, Ruhr-Universität reserves the right to make exceptions to the regulations stated under 10.1. to 10.1.4.
10.2
Starter courses and other supervised starter trainings with more than one training dates
10.2.1
The booking is binding. After the booking, the participant is generally not entitled to a refund.
10.2.2
For courses with more than one training date, the regulations under 5.1, 5.2 and 5.4 shall apply.
10.2.3
Regulation 5.3 shall likewise apply; however, the claim to a refundable portion of the fee due to proven inability to participate in sport activities by medical certificate shall be calculated as follows:
If at the onset of illness
After the fourth training date, participants are not entitled to a refund of the fee.
Generally, the entitlement to unrestricted training in the gym facilities expires with the submission of a certificate confirming an inability to participate in sport activities for the duration of the course according to 10.2.
10.2.4
If the amount per reimbursement resulting from clause 10.2.3 is equal to or less than 5€, university sports is exempt from the obligation to reimburse.
11.1
Transferring to another training programme under clauses 5 and 10.2 is generally possible if the following conditions are met.
It is generally not possible to transfer a Unifit card (clause 10.1).
Ruhr-Universität reserves the right to make exceptions in justified cases.
11.2
In the event of transferring to a course with a higher fee, the participant agrees that the difference in fees will be collected by direct debiting. In the event of transferring to a course with a lower fee, there will be no (partial) refund of the fee.
Transferring is only possible through the University Sports department.
12.1
The periods in which the training programmes are offered are indicated on the University Sports website.
12.2
A course or event shall be cancelled
12.3
If a course under clauses 2.2.1 and 2.2.3 is cancelled, there is no claim to a refund or alternative dates.
12.4
If a course is cancelled more than once for reasons not listed in clause 12.2, Ruhr-Universität will explore the possibility of setting up alternative dates. However, these may differ from the originally booked course day, course time and course location, unless otherwise possible.
12.5
If an event under clause 2.2.2 and 2.2.4 is cancelled, participants shall be entitled to a full refund.
12.6
If a course under clauses 2.2.6.2 or 2.2.6.3 is cancelled, participants shall be entitled to an alternative date.
Ruhr-Universität can combine training programmes or cancel them altogether if there is too little interest. Participants who have already paid the fee at the time of cancellation or modification may be transferred by the University Sports office to another training programme of their choice within the same fee group in the current programme, subject to availability; or they may be refunded the fee paid in full; or, in the event of a change or cancellation of training programmes during the ongoing semester, they may be refunded on a pro rata basis as per clauses 5.3 and 5.5.
Ruhr-Universität is permitted to use audio and video recordings made in the context of University Sports programmes and featuring participants for the purpose of media coverage, for its own advertising purposes and for archiving.
15.1
Sportswear: Any sport facilities may only be entered with clean and suitable sports shoes. Suitable clothing must be brought for each training programme. Please refer to the relevant instructions in the respective course descriptions.
15.2
Supervision of sport facilities: Access to all sports facilities used for university sports activities is only permitted to authorised persons. Course instructors, facility managers and other authorised University Sports personnel are entitled and obliged to deny access to other persons. In the event of gross misconduct, course leaders, facility managers and other authorised University Sports personnel have the right to ban persons from the premises.
15.3
Theft: Ruhr-Universität is not liable for theft. All participants are advised not to bring their valuables (jewellery etc.) to the facilities.
15.4
Insurance:
All students of Ruhr-Universität Bochum as well as students of the cooperating universities listed under “2. Terms and conditions” are insured against accidents by the authority for accident insurance of the state of North Rhine-Westphalia, as long as they participate in training programmes that are organised by University Sports during the specified times. Therefore, there is no insurance cover for subscriptions, one-off bookings, tournaments and unsupervised training using the Unifit card. Private insurance cover is strongly recommended.
Workers and employees are only insured against accidents if the sport activity can be considered company sports in accordance with the conditions stipulated by Unfallkasse NRW. This applies only to training programmes that are available exclusively to employees and that take place during the usual working hours and on a regular basis. Private insurance cover is therefore strongly recommended.
Tenured employees are not insured against accidents when participating in university sports or company sports.
Participation in Online-offers/courses of the University Sports Department is principally not insured against accidents.
Alumni/third parties participating in the university sports programme are not insured. They are responsible for their own health and accident insurance.
Accidents suffered by RUB students must be reported immediately to Mr. Crell at Akademisches Förderungswerk, Mail: unfallanzeige-rub-studierende@akafoe.de, phone: 0234 - 32- 11601.
In addition, all university sports participants are advised to take out liability insurance.
